The Second Amendment to the United States Constitution reads, “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”

Today is kind of special to me. This is the one year aniversary of clicking a button on facebook and sending out a message to The American Patriots to help halt the invasion and secure the border beginning with The Laredo Texas crossing.. We were gonna build a fence and defend the southern border since the federal government wasnt. Texas wasn’t either. We chose Laredo due to some particularly ugly intel we recieved from militia recon there. 

I called Texas Governor Perry office several times warning them of what was going on down here. That large groups of women and children were being sent thru to surrender themselves to border patrol as a diversion to tie up our borderpatrolmen while the real bad guys come waltzing in unhindered at a different location. Our Honorable Border Patrolmen were too busy making P,B & J sandwiches and changing dirty diapers than doing what they love to do which is defend the border.. I got sick of it…
I got sick of our Border Patrol having their hands tied by federal mandates that facilitated the invasion and the invaders.. Thank you Eric Holder you p.o.s. I hope I live long enough to see him hang for his crimes against America and We The People… Mr Fast and Furious who got Brian Terry killed along with at least 30 other people from both sides of the border with his gun running schemes and aiding the enemy.

(a) The reserve militia is not subject to active military duty, except that the governor may call into service the portion of the reserve militia needed for the period required in case of war, insurrection, invasion or prevention of invasion, suppression of riot, tumult, or breach of peace or to aid civil officers to execute law or serve process.

      (b) The governor may assign members of the reserve militia who are called into service to existing organizations of the state military forces or organize them as circumstances require. Acts 1987, 70th Leg., ch. 147, Sec. 1, eff. Sept. 1, 1987.

    • Sec. 431.072. COUNTY EMERGENCY BOARD. The county emergency board of each county consists of the county judge, sheriff, and tax assessor-collector. If one of those officers is unable to act, the governor shall designate another public official to serve on the board.Acts 1987, 70th Leg., ch. 147, Sec. 1, eff. Sept. 1, 1987.
    • Sec. 431.073. DRAFT. (a) The governor, by order to the county emergency board, shall apportion the number of members of the reserve militia called into service among the counties by draft according to each county’s population or by other means the governor directs. The county emergency board shall establish fair and equitable procedures for selection of persons to fill the draft according to regulations adopted by the governor. On completion of the selection, the board shall deliver a list of the persons selected to the governor and notify each person selected of the time and place to appear and report.(b) A member of the reserve militia while in active service is a member of the state military forces under Section 432.001(16), and is subject to the punitive provisions of Chapter 432. A member who does not appear at the time and place designated by the county emergency board shall be punished as a court-martial directs. Acts 1987, 70th Leg., ch. 147, Sec. 1, eff. Sept. 1, 1987.
    • Sec. 431.074. PENALTY. (a) A member of a county emergency board who neglects or refuses to perform a duty required by this subchapter commits an offense.(b) An offense under this section is a misdemeanor punishable by a fine of not more than $1,000 and confinement in jail for not less than six nor more than 12 months. Camp Lone Star – The Arrest of K. C. Massey

Yesterday, in the early afternoon, Kevin (K.C.) Massey, 48, was arrested in a motel room near Brownsville, Texas. Massey was one of the organizers of Camp Lone Star, which has been turning back, or turning over to the Border Protection Service (BPS), illegal aliens attempting to cross the Southern border. He was alone when the FBI and BATF arrested him, charging him with Felony Possession of a Firearm. He was convicted in 1988 of burglary – over a quarter of a century ago. To better understand the charge against Massey, I refer you to a previous article on a similar situation, “No bended knee for me” – the Charge against Robert Beecher. It would appear that Massey is subject to the same intentional misinterpretation of the Federal Statute.

These occurrences (Beecher and Massey) should provide adequate warning to patriots, especially those who have a felony record, that there is a concerted effort on the part of government to find cause to bring charges against you and take your guns away. They also provide insight into the tactics that the government is using to cull the patriot community of as many as they can, reducing the remaining numbers, and intimidating those who remain.

Khristy Massey breaks her silence and tells her story. Her own words are as follows…..

Around 1:30 pm on monday afternoon October 21, 2014 me and my son were outside in the driveway of my home in Quinlan, Tx. All at once cars started pulling into my yard. Several men got out of the cars. Two of the six men approached me and one of them said that they needed to speak with me alone and wanted to know if there was anyone else at my house. I noticed that the two men that approached me had weapons. One of them stated that he didn’t want anyone else to hear our conversation. I stated that only my son and I were home. He told me that my husband had been arrested in Brownsville, Tx which is 600 miles away from my residence.

Some of the other men there started trying to come towards me and were told to back up and not crowd me. The others backed away and surrounded my son at the end of the driveway. The man showed me his badge. I was in shock but I believe the badge said FBI.

He stated that my husband was cooperating which would only help his case. He stated that it would be in my best interest to cooperate as well. He said that they wanted permission to come in my home and retrieve any guns, magazines and ammunition that I had in my home. He also said that he would like to sit down and talk to my about everything I know about the militia. He stated that this would be my one and only chance to help my husband. He said that my husband would be facing 3 to 5 years in federal prison but if we would cooperate that he may be able to speak to someone about getting this time reduced.

He also informed me that federal time in prison is day for day with no early release. They did not have a search warrant for my residence. When I denied entrance into my house he stated that if I tried to remove any of the guns from my possession or transfer them to anyone else that they would be back with a pair of silver bracelets for me. I stated that I didn’t know anything and that I wasn’t going to do anything because I had done nothing wrong.

He said that they know every gun that my husband has and that they know there are guns registered to me that really aren’t mine. He also stated that I was unaware of where they have bugs and who their informants are. The final thing he told me before they left was that it would be in my best interest not to let this get out into the community because that would only make things worse.

The men then got in their cars and pulled out of my driveway. I was shaking and distraught. Not knowing what to do and now paranoid about using my phone, I got in my car and drove down the road to my friends house to use her phone. I placed a phone call to my husbands father who was career military in the hopes that he might have some guidance for what I should do.

I stayed at my friends house for about 20 minutes and then decided to go back home. As I approached my home I noticed two of the vehicles parked on the opposite side of the road from my house. I pulled in the driveway for a moment before deciding not to stay there. At this point I felt threatened and unsafe.

I drove to a public place where I knew people and went inside to see if they could help me make some sense of all of this. As I was heading toward this safe place I noticed various vehicles sitting on the side of the road and at a convenience store nearby. I didn’t know who to talk to or where to turn. I was paranoid that my car may have been bugged and I was sure that my cell phone had been tapped. I stayed at my safe place for about an hour and when I heard from my other son that he was on his way home from work I returned home.

Friends and family came to my house for support. My youngest son called in to work telling them he would not be in the following day. He and a friend stayed up all night watching our house. I wasn’t able to fall asleep until 3:30 am. I was contacted by a neighbor saying that she had seen cars parked on the side of the road a day or two before the FBI showing up at my house. There were also cars spotted on my road up until 9:00 pm Monday night.

Tuesday morning I was informed that my husband was not allowed bond at his arraignment. He was then moved by US Marshall’s to a federal detention facility.

Militia Member Charged in Federal Court

BROWNSVILLE – A member of a militia camped out south of Brownsville has been charged in federal court.

The man, John Frederick Foerster, is accused of being a felon in possession of a firearm. Agents with the ATF launched an investigation after a Border Patrol agent opened fire on Foerster on Aug. 29 near the Rio Grande.

Agents arrested Foerster Tuesday.

A criminal complaint states that agents from the Fort Brown Border Patrol Station were patrolling a brushy area when they encountered Foerster. According to the complaint, Foerster pointed a firearm at one of the agents, who fired several shots at Foerster.

Foerster was not injured in the incident.

Foerster is a member of “Rusty’s Rangers,” a group of armed civilians patrolling the border south of Brownsville, according to the complaint.

Border Patrol agents confiscated an AK-47-type weapon from Foerster after the incident. They also disarmed two other members of the militia who were in the immediate vicinity of the incident. One of those men, Kevin Lyndel Massey, also was carrying an AK-47 variant, the complaint states.

Massey was arrested Monday and charged on Tuesday with being a felon in possession of a firearm.

Investigators confiscated several more weapons during the investigation.

Last week, two men from the citizen border watch group “Camp Lonestar” were arrested. One of the men, Kevin Massey, was arrested by Bureau of Alcohol, Tobacco, Firearms and Explosives agents on October 20 after it was “discovered” that “he is a felon and was in possession of a firearm.”

The day after Massey was arrested, a local Fox affiliate reported that Cameron County Sheriff Omar Lucio evidently went on a fishing expedition, as he said that he had “asked for a record check on the militia to ensure they [citizen patrol group] were following the law.” But on October 22, Frank Ortega, resident agent in charge of the Brownsville Field Office of the ATF, was quoted as saying that “[T]here was a federal arrest warrant for him.”

The warrant was “sealed.”

On October 23, John Foerster, also of Camp Lonestar, was also arrested “on a charge of being a felon in possession of a weapon,” as reported at the Monitor, who added:

Foerster is accused of pointing a weapon at a U.S. Border Patrol agent on Aug. 29 in Brownsville. The documents state Foerster was hiding in brush and pointed a firearm at an agent who encountered him. The agent reportedly fired several shots at the militia man.

The day before, Officer.com reported:

On Aug. 29, a U.S. Border Patrol agent, while chasing immigrants thought to be entering the country illegally, fired several rounds at an armed American Patriot walking near the banks of the Rio Grande.

At the time of the August 29 shooting, a report at the Associated Press stated that “agents had been chasing a group of immigrants east of Brownsville Friday afternoon when an agent saw a man holding a gun near the Rio Grande. The agent fired four shots, but did not hit the man. The man then dropped his gun and identified himself as a member of a militia.”

As observed at Bearing Arms,

Fortunately for the militiaman the Border Patrol agent can’t shoot straight, and he [the citizen patrol member] was unharmed.

At the time, the AP reported, Sheriff Lucio “said the incident occurred on private property and it appeared the man had permission to be there.”

The AP account is heavily disputed by Kevin Massey, as noted below.

Cameron County Sheriff Omar Lucio was also quoted in the article saying, “We really don’t need the militia here.” Lucio also “noted that with the Border Patrol, Texas Department of Public Safety and local law enforcement, there are enough agencies working to secure the border.”

David Gara, 51, who lives on the border, said he prefers the children immigrants to the drug smugglers who used to try to sneak in from Mexico. Still, even he admits something has to be done. ‘In the past month I’ve seen it everyday,’ he said. ‘You gotta draw the line somewhere… This can’t go on forever.’

Property Owner Looking for Protection for his Land

Rusty Monsees owns the property where Camp Lonestar operates. The civilian border protection group, self-titled Rusty’s Rangers, are under the scrutiny of federal investigators.

Since August, four members were arrested and two face federal charges.

Monsees said, “This ultimately falls back on me because I asked them for help.”

He said his land, which stretches for several acres along the Rio Grande, is vulnerable and “has always been an area which had a lot of crossings.”

He admits some of the first volunteers who answered his call came with criminal records and personal agendas.

He said the camp is different today.

“The ones that are here now, I have gone through and I have checked. They are bonafide as they say they are,” said Monsees.

His fears are very real and he believes without this personal private protection, his life is danger.

Monsees said, “If you don’t help me, I’m going to be dead.”

He is not ready to retreat. The Brownsville native hopes he can replace these men with volunteers who have nothing to hide.

SUBJECT: BP AGENT DISCHARGES FIREARM AT VOLUNTEER CONCERNED CITIZEN

On or about Wednesday 27AUG14 at approx 18:00 Archie, a fellow teammate at Camp Lonestar, met Mr Aguliar curator of the wildlife sanctuary located on the Texas Border at a Gas Station named “Stripes”. After speaking with Archie, Mr. Agulair showed interest in having us patrol the sanctuary due to illegal alien incursions onto his property. He invited us to come speak with him.

On 29AUG14 at approx. 14:00 We (KC, Wolf, Jesus) went to speak with Mr. Aguliar about patrolling his property. After agreeing to his terms for patrol on his property, we set out to scout the new property along the river. After we cleaned up 3 crossing spots(we remove refuse to beautify our state and to allow us to monitor new traffic) we observed a dismounted Border Patrol Agent walking down the river road. We knew from working with BP when they are dismounted they are actively looking for illegals that have crossed into US territory. I approached the Agent and asked him what was going on. The BP agent informed us that they had illegals being pushed toward our location from other BP agents. We asked if we could help him and he said yes. We heard voices coming from the river so we deployed to the river approx. 75 yards apart, which was to the rear position of the BP agents position to cover his back. Wolf took the most Northern position I assumed the middle position and Jesus was in the southern position. While I was in a covered position on the river I observed a heavily tattooed late 20’s early 30’s Hispanic male hollering and whistling up and down the river. While observing suspect I heard a series of approx. 5 gun shots ring out. My first impression was, it was the cartel flexing their might to attempt to intimidate us as they had done previously to BP. I observed suspect until he got out of my visual range. When I went back up to the top of the ridge to reposition myself to further observe the suspect, my teammate Wolf informed me a BP Captain was looking for me. I immediately proceeded to meet the Captain on the border road. I observed the BP Captain coming toward me holding the AK Pistol Jesus was carrying and Jesus following behind the Agent. When the BP Captain and I got within speaking range he informed me that one of his agents discharged his firearm at my teammate(Jesus) approx. 5 times. He stated to me his agent mistook our teammate as an illegal and saw the weapon and he opened fire without provocation or without ordering Jesus to drop his weapon. I then observed the Agent who discharged his weapon and he was visibly shaken. His skin was flushed and his color appeared to be white. After about 20 minutes the Agent was back to a normal darker skin tone. The BP Captain then asked us to move out of the “HOT” zone for our security to further discuss the incidental discharge. We agreed and moved approx. 250 yards from the site of the shooting.

When we arrived at the new location the BP agent chose, we stopped approx. 30 yds. behind his vehicle. I disarmed and stowed my side arm in the glove box of the mule and left my rifle leaning on the gun rack mounted to the mule. Wolf left his rifle laying on the back seat of the mule and we dismounted. Wolf retained his pistol concealed under his blouse. We then approached the BP Captain and continued to discuss the incident. After approx. 15 minutes BP agents started to gather at our location to secure the scene for the ensuing investigation into the discharge of the BP agents firearm. The BP Captain asked us if he could secure our weapons since we did have illegals in the area and we were not in a position to protect the weapons from being used against us by an illegal. We consented to him securing the weapons in his vehicle. The BP Captain also took possession of my GoPro camera that was mounted to the mule.

After approx. 45 minutes a Charge Sargent of the Cameron County sheriffs office arrived and took possession of our identification and he proceeded to run our names and backgrounds. He also ran the numbers on our weapons which all came back clear. I had to scratch the paint off of my AK pistol for the BP and deputy to obtain the serial number. He also ran the VIN of my mule which was clear. Shortly afterwards top ranking Border Patrol commanders and investigators arrived. The FBI and Homeland security investigators arrived on the scene. I was questioned by Homeland Security agent and an FBI agent about what I knew and observed. I answered all questions posed to me truly and accurately. After approx. 5 hours being detained by Federal and county officials we were told we were free to go.

While we were waiting for our identification back we observed the Deputy Sheriff taking possession of our weapons. When I questioned why he was taking our weapons after they were cleared as not stolen and we had every legal right to possess them on the private property we had permission to be on, I was informed they were “Part of the investigation” into the discharge of a weapon by a federal agent. I again questioned why our weapons were part of an investigation that we had not committed and wrong doing. The Deputy asserted he was told to do so and I could retrieve my weapons Monday 1SEPT14 at the Sheriffs office. I was not given an inventory list of the weapons being held nor for my GoPro camera they refused to give back due to their investigation. I was just told to go to the Sheriffs office next week. The SSG with the Cameron County sheriffs office returned our identification and told us we were free to go. Again I asked about my weapons and camera and again I was refused access to my lawful property. We mounted up on the mule and departed to our base camp.

CAMERON COUNTY – CHANNEL 5 crews have located the man that was shot at by a U.S. Border Patrol agent Friday afternoon.

He says he was very surprised to be shot at since they are there to support the Border Patrol.

Because of the sensitivity of what he does, he asked CHANNEL 5 NEWS to protect his identity.

The man who we will call “Jack” says he and two others had permission to be on the private property when the incident took place.

The group says the property owner wanted them to help because of the damage was being done when people were crossing into the United States.

K.C. Massey, who was in charge of the group at the time, says they were working to prepare the property to secure its border.

“We were going through scouting and finding the crossing and then we were collecting the trash, said Massey. “We do that for two reasons. One to beautify our state and two, it allows us to tell when new traffic is coming through because there will be new trash.”

“Jack” said, “I was carrying a weapon so I pointed it away from me. I said, ‘Hey, I’m helping,’ and he kept on firing.”

The men say they don’t plan on leaving any time soon. They plan on being a little more careful when they see Border Patrol where they haven’t been before.

The group of border protectors told us they are frustrated that they have been given the militia brand.

They say they have never been associated with a milita.

BROWNSVILLE – A militia member who came under Border Patrol gunfire Friday is a felon.

The man, John Frederick Forester, is part of a group camped out on private land near the river.

Officials said Forester was armed when a Border Patrol agent opened fire on him. The militia member was not injured.

Records show Forester has two misdemeanor convictions for theft and trespassing and felony convictions for burglary of a building. He served prison time.

State law states a felon can’t use guns after a conviction and before the fifth anniversary of his or her release from prison. Federal law, though, prohibits felons from ever possessing firearms.

Records show Forester followed state laws, but is in violation of federal statutes.

Cameron County sheriff officials said the FBI is handling the investigation.

CHANNEL 5 NEWS visited the group’s camp Wednesday to find out if they do background checks on members. Forester refused to speak with the news crew.

The group’s commander said they only check to see if applicants are on probation or parole.

The commander said the group is contemplating suing the federal government and the Cameron County Sheriff’s Department over the shots-fired incident.

The group’s leader said the agent opened fire before identifying who they were. He said the sheriff’s department is mishandling the investigation.

Forester told CHANNEL 5 NEWS in a previous interview that he is from Brownsville.

“I’m still going to be out there. I’m still going to be vigilant. I might be a little louder towards the agents so that they know that I’m there. I might even put a red strobe light on my forehead so that they can see. I’m not leaving,” he said after the shots-fired incident.

Does it matter what the charge is? He’s out there protecting us while the government is committing felony after felony on top of even more felonies.

A state lawmaker in Texas is praising the arrival of militias along the US border, which he says are deterring drug cartels and illegal immigrants from the area. However, the US Customs and Border Patrol (CBP) has rebuked the groups for their presence.

Republican state Rep. Doug Miller toured the Rio Grande Valley in Texas on Monday with state police, riding in a Texas Department of Public Safety (DPS) gun boat and in a helicopter near McAllen ‒ the epicenter of the battle between anti-immigration and human rights advocacy groups during the recent influx of illegal immigrants along the Texas-Mexico border. Miller told the San Antonio Express-News that he spoke with DPS officers about the militias. The tour was part of an “informational trip” to observe the “cartel’s system to get people and drugs across the border,” Miller said.

The three-term state representative said the militias “are private citizens and they have a right to be there and a right to bear arms if they have permission of the land owner.”

“What I was told is (the militia groups) are on private property, helping ranchers and owners to keep illegals coming onto or through their property … and there haven’t been any problems,” Miller told the Express-News. “When (the groups) are coming into an area, they’ve been very forthright, letting (law enforcement) know they were there so there wouldn’t be some type of negative interaction.”

The militias began organizing in mid-June. By the end of July, more than 10 independently operated private militia groups were patrolling the border between Texas and Mexico, ignoring calls from Customs and Border Patrol to back off and inviting criticism from local lawmakers. In more than 30 images obtained by the Express-News, “dozens of members” can be seen, sometimes talking to CBP agents. In one photo, a CBP agent can be seen giving directions to armed militia members operating a vehicle.

“We need people out here to help control the influx of people,”  “As of a month ago, there were 130,000 people that have crossed the border illegally since January. Our economy cannot handle that. In the past month, we’ve added another 30 or 40,000 [undocumented immigrants].”

In June,CBP spoke out against those gathering around the border aiming to keep watch over immigrants attempting to cross the border. The agency said it does not “endorse or support any private group or organization from taking matters into their own hands, as it could have disastrous personal and public safety consequences.”

Miller said the influx of Central American children illegally crossing the border us due to Mexican drug cartels that are “helping and encouraging people to send their children” to the United States.

“It is all part of the strategy of the cartels to cause distractions for border patrol and for our law enforcement so they can continue or enhance their drug operation,” Miller continued, adding that the cartels are the root of violence and poverty in the Central American countries.

Between October 1, 2013 and July 31, 2014, nearly 63,000 unaccompanied alien children (0-17 years of age) were apprehended along the southwestern border of the US, according to the latest statistics from CBP – a 100 percent increase over the same time in fiscal year 2013. During that same period, agents also apprehended almost 63,000 family units – a 471 percent increase over FY2013. There have been close to 230,000 “other than Mexicans (OTMs)” entering the country over the last nine months, a designation that makes it difficult for the federal government to quickly deport the immigrants back to their home countries in Central America.

The militias are there to assist CBP agents who are overwhelmed by the massive spike in undocumented immigrants this year, leaders of the groups have said. Minutemen Project co-founder Jim Gilchrist told KPHO-TV that he doesn’t want his militiamen to act aggressively. Rather, he said, his group will only assist federal border agents.

“You do not put a hand on anyone, you do not talk to anyone, you do not confront anyone,” Gilchrist told the station. “You report to Border Patrol.”

The arrival of the militias and talk of amnesty and asylum for the immigrants have combined to create a dip in morale for CBP agents, WND reported last Tuesday.

“With all the talk of comprehensive immigration reform and amnesty coming from Washington, so many people illegally crossing the border have it in their minds that ‘I need to get away,’ and whoever is standing in their way is going to suffer their wrath,” Chris Cabrera, a Border Patrol agent for nearly 13 years and a vice president in the National Border Patrol Council Local 3307, said in an interview with WND.

“The morale is not there and the Border Patrol service is not behind its agents,” Cabrera said.

Although neither Texas Gov. Rick Perry nor Attorney General Greg Abbott (who is currently a candidate for Texas governor) have mentioned the militias ‒ which may signal tacit approval of the groups ‒ Texan Democrats, some local officials, and the CBP have spoken out against them.

“Local law enforcement and Border Patrol agents have been clear. The presence of these outside, independent militia groups does nothing to secure the border; it only creates an unsafe situation for law enforcement officials that are protecting our communities,” state Sen. Leticia Van de Putte, a Democrat from San Antonio, said in a statement.

But Miller credits the militias ‒ along with the 1,000 National Guard troops that Perry activated in July to join the state’s Department of Public Safety in an effort to combat human smuggling across the country’s southern border ‒ with deterring immigrants and cartel members.

“We have secured state resources in the absence of federal assistance,” Miller said. “It is encouraging to me, as a state lawmaker, that we have sent professional personnel to the border. We’ll never have 100 percent secure border, but I think with what we’ve done, we’ve sent a very clear message to Mexico that we are not going to accept this.”

Texas Reserve Militia Info and Guidelines

    • Sec. 431.001. DEFINITIONS. In this chapter:

      (1) “Reserve militia” means the persons liable to serve, but not serving, in the state military forces.

      (1-a) “Servicemember” has the meaning assigned by Section 161.551, Health and Safety Code.

      (2) “State militia” means the state military forces and the reserve militia.

      (3) “State military forces” means the Texas National Guard, the Texas State Guard, and any other active militia or military force organized under state law.

      (4) “Texas National Guard” means the Texas Army National Guard and the Texas Air National Guard.

      (5) “Employee” has the meaning assigned by Section 21.002, Labor Code.

      (6) “Employer” has the meaning assigned by Section 21.002, Labor Code.

      (7) “Political subdivision” has the meaning assigned by Section 21.002, Labor Code. Acts 1987, 70th Leg., ch. 147, Sec. 1, eff. Sept. 1, 1987.

    • SUBCHAPTER E. RESERVE MILITIA

      Sec. 431.071. MILITARY DUTY. (a) The reserve militia is not subject to active military duty, except that the governor may call into service the portion of the reserve militia needed for the period required in case of war, insurrection, invasion or prevention of invasion, suppression of riot, tumult, or breach of peace or to aid civil officers to execute law or serve process.

      (b) The governor may assign members of the reserve militia who are called into service to existing organizations of the state military forces or organize them as circumstances require. Acts 1987, 70th Leg., ch. 147, Sec. 1, eff. Sept. 1, 1987.

    • Sec. 431.072. COUNTY EMERGENCY BOARD. The county emergency board of each county consists of the county judge, sheriff, and tax assessor-collector. If one of those officers is unable to act, the governor shall designate another public official to serve on the board.

      Acts 1987, 70th Leg., ch. 147, Sec. 1, eff. Sept. 1, 1987.

    • Sec. 431.073. DRAFT. (a) The governor, by order to the county emergency board, shall apportion the number of members of the reserve militia called into service among the counties by draft according to each county’s population or by other means the governor directs. The county emergency board shall establish fair and equitable procedures for selection of persons to fill the draft according to regulations adopted by the governor. On completion of the selection, the board shall deliver a list of the persons selected to the governor and notify each person selected of the time and place to appear and report.

      (b) A member of the reserve militia while in active service is a member of the state military forces under Section 432.001(16), and is subject to the punitive provisions of Chapter 432. A member who does not appear at the time and place designated by the county emergency board shall be punished as a court-martial directs. Acts 1987, 70th Leg., ch. 147, Sec. 1, eff. Sept. 1, 1987.

    • Sec. 431.074. PENALTY. (a) A member of a county emergency board who neglects or refuses to perform a duty required by this subchapter commits an offense.

      (b) An offense under this section is a misdemeanor punishable by a fine of not more than $1,000 and confinement in jail for not less than six nor more than 12 months. Acts 1987, 70th Leg., ch. 147, Sec. 1, eff. Sept. 1, 1987.

In the letter, state Democrats called the militias “lawless” and accused them of perpetuating “the stigma that the border is a war zone.”

Perhaps the reason there is a stigma about the border being a war zone is because it is one. Violent gang members and drug cartels have attacked Border Patrol agents, not to mention the Mexican military helicopter that opened fire on Americans, making the border a very unsafe place to be.

Truth be told, the militia shouldn’t be down there, because it’s the president’s job to provide all of the proper resources needed to secure the border. Unfortunately, since he refuses to do his job, these individuals are filling in the gap.

Attorney General Greg Abbott shrugged the letter off calling it a “partisan political stunt” and went on to say that rather than whining about the militia, they “should work with their Republican colleagues to secure federal funding for the state’s border security efforts.”

It is apparent, then, that protection from invasion warrants the attention, and cooperation, of the federal government. However, we must consider whether the States lost their right to repel invasion, absent the federal government fulfilling their oblation and guarantee. This, then, leads us to the 10th Amendment:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Congress was given the Power, though nothing makes that Power exclusive. If it had been exclusive, surely a prohibition against the state protecting its borders would have been written as a prohibition in Article I, Section 10.

Well, that all makes sense; however, can that right to protect a State’s borders be affirmed by example? Answer: Most assuredly. Though the incidents being used to demonstrate this “Right of the State” to protect its borders were from the early part of the 19th Century, there have been no changes to the Constitution that would eliminate that right.

Professional police not having been invented, the militia was the primary tool for enforcing the law in circumstances that went beyond the reach of the town constable, and it was also the primary source of defense against invasions and insurrection.

Calling out the militia thus meant calling out ordinary citizens, trained in military tactics (that’s the “well-regulated” part), bearing their own arms. The Framers — who had a deep and abiding fear of professional standing armies because of abuses by the British Crown — thought this safer. A professional standing army could turn on the people, placing its loyalty with its paymasters rather than with those it was supposed to protect. The militia, on the other hand, couldn’t betray the people because it was the people.

The Toledo War

In 1835, based upon an incorrect map of the region, two lines were established between the boundaries of Michigan and Ohio. The land within this disputed area comprised about 486 square miles. Ohio had become a state in 1803, though the boundary in dispute was between Ohio and the then territory of Michigan.

Beginning in late 1834, Michigan’s Territorial Governor Stevens Mason sent the Militia to the disputed line and claimed that he would not use force, so long as Ohioans stayed out of the disputed area. Ohioan responded by sending their Militia to the same area. Michigan’s militia ended up arresting some Ohio Surveyors and Officials, firing some shots into the air to scare off others from the survey party.

The dispute was finally settled where President Jackson and the Congress redefined the boundary between Ohio and the Territory of Michigan, give each portions of the disputed lands. Finally, in 1837. Michigan was granted statehood.

The extent of federal authority was limited to resolving the dispute politically. There was no federal armed intervention.

The Honey War

Missouri became a state in 1821. The boundaries of the state were defined in the Constitution adopted at statehood. The description of the Northern boundary, however, was unclear and lay in Indian lands. At the expiration of the Indian’s usage of the land, in 1836, Sullivan surveyed the boundary. The future Iowa was then a part of Wisconsin Territory. The land, based upon subsequent review of the description of Missouri’s boundary, and a correct interpretation, created an overlap of up to 12 miles.

When a Sheriff from Missouri entered the disputed land to collect taxes, the locals (future Iowans) disputed his jurisdiction and he was arrested. Iowa Governor Robert Lucas warned Missouri Governor Lilburn Boggs that the Missouri sheriffs would not be allowed to collect taxes in Iowa. Boggs then threatened militia action to enforce the collection of the taxes. Both governors then called out their militia to the disputed area. The only damage being the destruction of some profitable honey trees, hence the name of the war. The two militia were called off when the dispute was submitted to Congress, and eventually, to the United States Supreme Court.

Although Iowa attained statehood in 1846, the Court did not settle the dispute until 1851. The extent of federal authority was limited to resolving the dispute judicially. There was no federal armed intervention.

Conclusion

So, there, we have it. The Constitution remains unchanged, and the States in these disputes, called forth their respective militia to protect their boundaries. Though nobody was killed, the face off and the potential for real war was present. The only federal solution was political or judicial.

Suppose, then, that the intrusion, without question of a boundary dispute, exists. Suppose, also, that the intruders were not Americans, rather, are foreigners. Would the federal government have any more authority than what has been discussed? Would they be limited, as they were in the past, to either a negotiated political solution, or a judicial determination? Is it possible that the right is inherent, in each State (or even as a territory) to defend its borders, by use of the militia?

If some unconstitutional law; Some federal mandate; Some divisive compact between the federal and state government; or, Some financial obligation, precludes the state from protecting its own borders against invasion, is it not, under the current onslaught of illegal immigration across state borders, an abrogation of the responsibility of the governor of any state who refuses to fulfill his duty?

If he should fail to do so, then the People themselves should recognize that the right to self-defense against invasion resides, ultimately, with them, whether under the Congress, the President, or the State governor, or the People who would become that militia force. In addition, nothing within that Constitution prohibits the militia from acting upon its own behalf. It only provides for subordination, if the higher governing authority does not abrogate its responsibility. The Tenth Amendment:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

This is further supported by the oft-overlooked Ninth Amendment:

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

Ultimately, the final decision to act is in the hands of the People. It is their country; It does not belong to the Government. If the government refuses to act, especially, when the laws of the land require such action, both of federal and state government, the People are left naught — except to act on their own behalf — for their sake and the sake of their posterity.

‘Show of force’ from militias is deterring immigrants, drug cartels in Texas – state rep

A state lawmaker in Texas is praising the arrival of militias along the US border, which he says are deterring drug cartels and illegal immigrants from the area. However, the US Customs and Border Patrol (CBP) has rebuked the groups for their presence.

Republican state Rep. Doug Miller toured the Rio Grande Valley in Texas on Monday with state police, riding in a Texas Department of Public Safety (DPS) gun boat and in a helicopter near McAllen ‒ the epicenter of the battle between anti-immigration and human rights advocacy groups during the recent influx of illegal immigrants along the Texas-Mexico border. Miller told the San Antonio Express-News that he spoke with DPS officers about the militias. The tour was part of an “informational trip” to observe the “cartel’s system to get people and drugs across the border,” Miller said.

The three-term state representative said the militias “are private citizens and they have a right to be there and a right to bear arms if they have permission of the land owner.”

“What I was told is (the militia groups) are on private property, helping ranchers and owners to keep illegals coming onto or through their property … and there haven’t been any problems,” Miller told the Express-News. “When (the groups) are coming into an area, they’ve been very forthright, letting (law enforcement) know they were there so there wouldn’t be some type of negative interaction.”

The militias began organizing in mid-June. By the end of July, more than 10 independently operated private militia groups were patrolling the border between Texas and Mexico, ignoring calls from Customs and Border Patrol to back off and inviting criticism from local lawmakers. In more than 30 images obtained by the Express-News, “dozens of members” can be seen, sometimes talking to CBP agents. In one photo, a CBP agent can be seen giving directions to armed militia members operating a vehicle.

Barbie Rogers, who runs the Patriot Information Hotline – a 24-hour conference line that the militias are using to coordinate their efforts – told VICE News that 14 groups have taken up patrol along the border from Texas to California, with more on the way.

“We need people out here to help control the influx of people,” she said. “As of a month ago, there were 130,000 people that have crossed the border illegally since January. Our economy cannot handle that. In the past month, we’ve added another 30 or 40,000 [undocumented immigrants].”

In June,CBP spoke out against those gathering around the border aiming to keep watch over immigrants attempting to cross the border. The agency said it does not “endorse or support any private group or organization from taking matters into their own hands, as it could have disastrous personal and public safety consequences.”

Miller said the influx of Central American children illegally crossing the border us due to Mexican drug cartels that are “helping and encouraging people to send their children” to the United States.

“It is all part of the strategy of the cartels to cause distractions for border patrol and for our law enforcement so they can continue or enhance their drug operation,” Miller continued, adding that the cartels are the root of violence and poverty in the Central American countries.

Between October 1, 2013 and July 31, 2014, nearly 63,000 unaccompanied alien children (0-17 years of age) were apprehended along the southwestern border of the US, according to the latest statistics from CBP – a 100 percent increase over the same time in fiscal year 2013. During that same period, agents also apprehended almost 63,000 family units – a 471 percent increase over FY2013. There have been close to 230,000 “other than Mexicans (OTMs)” entering the country over the last nine months, a designation that makes it difficult for the federal government to quickly deport the immigrants back to their home countries in Central America.

The militias are there to assist CBP agents who are overwhelmed by the massive spike in undocumented immigrants this year, leaders of the groups have said. Minutemen Project co-founder Jim Gilchrist told KPHO-TV that he doesn’t want his militiamen to act aggressively. Rather, he said, his group will only assist federal border agents.

“You do not put a hand on anyone, you do not talk to anyone, you do not confront anyone,” Gilchrist told the station. “You report to Border Patrol.”

The arrival of the militias and talk of amnesty and asylum for the immigrants have combined to create a dip in morale for CBP agents, WND reported last Tuesday.

“With all the talk of comprehensive immigration reform and amnesty coming from Washington, so many people illegally crossing the border have it in their minds that ‘I need to get away,’ and whoever is standing in their way is going to suffer their wrath,” Chris Cabrera, a Border Patrol agent for nearly 13 years and a vice president in the National Border Patrol Council Local 3307, said in an interview with WND.

“The morale is not there and the Border Patrol service is not behind its agents,” Cabrera said.

Although neither Texas Gov. Rick Perry nor Attorney General Greg Abbott (who is currently a candidate for Texas governor) have mentioned the militias ‒ which may signal tacit approval of the groups ‒ Texan Democrats, some local officials, and the CBP have spoken out against them.

“Local law enforcement and Border Patrol agents have been clear. The presence of these outside, independent militia groups does nothing to secure the border; it only creates an unsafe situation for law enforcement officials that are protecting our communities,” state Sen. Leticia Van de Putte, a Democrat from San Antonio, said in a statement.

But Miller credits the militias ‒ along with the 1,000 National Guard troops that Perry activated in July to join the state’s Department of Public Safety in an effort to combat human smuggling across the country’s southern border ‒ with deterring immigrants and cartel members.

“We have secured state resources in the absence of federal assistance,” Miller said. “It is encouraging to me, as a state lawmaker, that we have sent professional personnel to the border. We’ll never have 100 percent secure border, but I think with what we’ve done, we’ve sent a very clear message to Mexico that we are not going to accept this.”

By now everyone is well aware of the disaster happening at the border with thousands of illegals pouring into the country, while President Obama watches gleefully, awaiting the moment he can declare an emergency and pass amnesty with an executive order.

Since the Obama administration wants this crisis to continue escalating, they’ve opted to do nothing to secure the border or offer assistance to help communities pay for the cost of caring for illegal immigrants.

As a result, many border states, like Texas, have decided to take action on their own, with Gov. Rick Perry deploying the National Guard to help provide additional security forces at the southern border.

While this is improving the situation a bit, ranchers are still experiencing break-ins and other dangers from illegals, which has prompted armed militia groups to roll into the Lone Star state to help put the border on lock down.

According to the Dallas News, the presence of the militia hasn’t been a welcomed sight for everyone, as the Texas Democratic congressional delegation wrote a letter to the state’s attorney general demanding that he define the kind of activities that militia can lawfully participate in, and for him to denounce their presence.

In the letter, state Democrats called the militias “lawless” and accused them of perpetuating “the stigma that the border is a war zone.”
